What is the McCloud Remedy in the UK?

Back in 2015, the government introduced major reforms to public sector pensions, creating the new 2015 Pension Scheme. Many NHS members were moved from their legacy schemes such as the 1995 or 2008 section into this reformed scheme, unless they had transitional protection. However, this policy was later challenged in court under Judge McCloud, who ruled that the changes amounted to unlawful age discrimination.

In response, the government introduced corrective legislation known as the McCloud Remedy, designed to ensure fairness across all members by allowing affected individuals to choose, at retirement, which scheme legacy or reformed their benefits for the 2015–2022 remedy period should be based on.

Who Could Benefit?

You may be affected if you:

  • Were in a public sector pension scheme on or before 31 March 2012
  • Had service on or after 1 April 2015
  • Worked at any time between 1 April 2015 – 31 March 2022 (the remedy period)

Sectors impacted include:

  • NHS Pension Scheme
  • Teachers’ Pension Scheme
  • Civil Service Pension Scheme
  • Police Pension Scheme
  • Firefighters’ Pension Scheme
  • Armed Forces Pension Scheme
  • Judiciary Pension Scheme
  • Local Government Pension Scheme (LGPS)

This means the NHS McCloud Remedy update is particularly important for doctors, consultants, and healthcare staff currently receiving their Remediable Pension Savings Statements (RPSS).

What Does It Mean for You?

At retirement, you’ll be given a choice for the remedy period:

  • Keep benefits in your legacy scheme (e.g. NHS 1995/2008, Teachers’ pre-2015, etc.)
  • Or move them to the reformed 2015 scheme

This choice could affect key factors such as:

  1. When you can retire
  2. The size of your pension & lump sum
  3. Whether you reclaim or pay extra Annual Allowance tax
